A judge is going to decide if an Okmulgee city council candidate will be eligible to run for office.
James Wesley Kirby filed for the councilman at large seat this past week and that filing has been contested.
Another candidate, Steven Baldridge, is claiming Kirby has two felonies and city warrants which would render him ineligible.
He is citing a bench warrant issued July 28, 2015 for Failure to Comply with a Lawful order, as well as two warrants issued July 22, 2015. One was for a felony charge of Knowingly Concealing Stolen Property and the second was Possession of A Controlled Substance.
Kirby was also sentenced to prison for knowingly concealing stolen property and possession of a controlled dangerous substance in Okmulgee County. He was to serve five years on each of those with the prison time to run concurrently.
When he filed, Kirby filled out the criminal history disclosure form acknowledging the two convictions and listed an April , 2014 warrant for failure to comply with a lawful order.
The hearing is scheduled Dec. 15 at 10 a.m.
