A settlement has been reached in the lawsuit against Mehlburger Brawley Engineering.
That settlement agreement was approved Tuesday at a special meeting of the Henryetta city council. It put an end to a four-year-long lawsuit that dealt with the work at the water treatment plant and intake facility on the Canadian River.
river intake areaThere were problems with the construction at the water plant that required the city to make additional repairs to stop leaks in the water storage tanks.
The river intake was said to have never supplied sufficient raw water to the water plant.
The lawsuit was originally filed in September, 2013 and a settlement reached earlier this month. That settlement was for an undisclosed amount of money and the court record did not reveal the total.
Defendants in the case were NRS, Inc., (formerly known as Mehlburger Brawley, Inc., and Robert Vaughan and John Derek Jackson.
With that settlement, the city was able to close out the three construction projects that utilized a loan from the Oklahoma Department of Environmental Quality.
During the special meeting, the council also approved the $199,000 grant from the Muscogee (Creek) nation Indian Health Service. That money is part of the funds currently being spent to build the million-gallon water tank east of town.
DM Tanks, the water tank contractor has been busy pouring the concrete walls that will eventually be put up replacing the dilapidated steel structure that was removed a few months ago. Work is expected to be completed by mid-October. Once the construction is finished, water quality tests will have to be performed before the tank can be used.
