A taser dart in the eye has resulted in a lawsuit being filed against the city of Henryetta.
Dustin Eugene Palmer filed the personal injury lawsuit seeking over $10,000 in damages.
The incident stemmed from a March, 2014 incident where he was alleged to have stolen a car from Dickey's Oil Pit.
Police captured Palmer at the Lake Road Apartments but had to use a taser to subdue him. When the taser was fired, police chief Steve Norman said it appeared a gust of wind caught one of the darts and sent it into an eye.
Palmer was found guilty of the auto theft charge and received a 10 year suspended sentence.
The case was filed in Okmulgee County District Court. No date has been set for the matter to be heard in court.
