A lawsuit for libel and slander has been filed by a Henryetta business against local resident Howard N. "Buck" Sheward, jr., Wednesday.
The lawsuit by Fountain View Manor was filed Wednesday in Okmulgee District Court and a temporary restraining order issued against Sheward.
Over $500,000 in damages is being sought in each of the two claims.
In the suit, Sheward is accused of making oral and written statements accusing the nursing home of embezzling city money and causing damage to a sewer line at the facility.
Tulsa attorney Joel L. Wohlgemuth said those statements are falsely accusing Fountain of committing a crime, being dishonest and, "tended to injure Fountain View in its business of providing quality nursing care services." He described that conduct of being, grossly negligent or reckless."
The restraining order granted by judge Michael Claver, prohibits Sheward from going onto the Fountain View property, taking photographs or videos of people on the nursing home property or harassing, intimidating or threatening anyone on the property.
Sheward is alleged to have repeatedly gone onto the property, "at all hours of the day and night, including midnight to 4 a.m." He is accused of taking photographs and videos and had been ordered by police to stay off the property.
A hearing on the restraining order has been set for Nov. 3 in district court.
