Christopher Jason Baumann will not be a candidate for Okmulgee County Sheriff.
The Oklahoma State Supreme Court denied a hearing on his motion to overturn the district court decision keeping him off the ballot.
Baumann's candidacy was contested by incumbent sheriff Eddy Rice who claimed he did not live in the county for the required six months prior to filing.
That claim was first upheld by the Okmulgee County Election Board then by the district court earlier this month.
Baumann had filed as a republican and, had he been allowed to run, would have faced Rice in the November election.
